Evaluation And Reform Of The Government Regulation To Telecom Industry In China

This paper describes the characteristics of the telecom industry's natural monopoly, which is academic cornerstone of the regulation to the telecom industry. Then it reviews the research of government regulation to the telecom industry at home and abroad, and analyses various policy of the causes and effects from two areas of regulation and deregulation. With dividing telecom industry into four different phases and summing up the characteristics of the different stages, readers can understand process of the government regulation in Chinese telecom industry. It summarizes telecom industry departments and self-government bodies in China; evaluates government regulation performance of Chinese telecom industry, analyses its exiting problems.Based on analyzing the regulation reform process of telecom industry in United States, Japan and other developed countries, it sums up the reform experiences and lessons in order to give Chinese telecom industry some suggestions. In the analyzing the ideas and measures of civil regulation of Chinese telecom industry, this paper expresses the difficulties of the Chinese telecom industry from two aspects of property rights and laws, which is useful to give the measures. This article considers that Chinese telecom industry reform of government regulation should speed up its civil reform, which makes for strengthening international competitive power of Chinese telecom industry, and improving the development level of the industry. It accords with international experience, but also conforms to actual situation. Therefore, this paper analyses need of civil reform, which should accelerate from expanding the scales and means of corporate finance, further relaxing regulation. But civil reform can't accomplish immediately. At the same time, we should reform the regulatory system from other areas. First of all, legal system of Chinese telecom industry should be established. China has promulgated many laws and regulations to the telecom industry, which accord with conditions of Chinese telecom regulations. But this can't conceal many problems: overlapping and fussy laws reduces the efficiency of the supervision and increases the difficulty of enforcement. Secondly, Chinese telecom industry should strengthen to build the regulatory institutions. Chinese regulatory institutions are lack of independence, legal status, lack of substantial regulatory powers, which can't implement the regulation on the telecom industry effectively. Finally, the telecom industry should strengthen the supervision of government regulation. It will help improve efficiency and quality of Chinese telecom industry, and be able to protect the interests of consumers and improve the society welfare.Finally, we believe that the health of the telecom industry cannot develop without government regulation. Our work will focus on how regulate telecom industry better in the new era. It must establish mechanisms in order to achieve a scientific control, accelerate the pace of development, and enhance their competitive power. In effective control mode, the building of the legal system, control to institutions, monitoring institutions, which is related to development prospects of Chinese telecom industry.
