The Claims Mechanism Study Base On Engineering Guarantee

The practice in abroad proves that engineering guarantee is effective credit restriction system, and the engineering guarantee is also introduced into our country in the 1980s. In the process, it develops fast and gets a good result, but also face a lot of questions. Under the documents research, finding that the claim mechanism of engineering guarantee base on contractor is one of key questions and the practice reflects the fact. Therefore how to perfect the claim mechanism is an important question.The article starts from the claim procedure of engineering guarantee, summarize the main questions by documents research, and mainly focus on contractor, owner, guarantor, supervisor and others aspects. On the basic summarizing the influence factors in home and abroad. In order to further study the importance of the aspects to the real engineering, demonstration methods was used. Firstly, two research hypotheses are put forward by literature review, the one is that these attributes in the literature affect the guarantee claim; the other one is that these attributes can be summed up some factors and there are a few relative important ones. And then we decide a questionnaire for the relative people in the guarantee according to the literature review and research hypothesis. All of the data were analyzed using the statistical package for social sciences (SPSS). Secondly, five key factors in guarantee claim were picked up, including the relation between the guarantee parts, the perfect of guarantee law system, the acknowledge between guarantee parts, the contractor's attention to guarantee claim and the supervisor's specialize level. At last, the proposal for the development of guarantee claim was given.
