The Present Situations Of Manipulations Of Securities Market And The Perfection Of The Laws And Rules In China

By making the prices of securities deviate from value so as to affect the free flow of capital, the manipulation of securities market harms the nvestors' interests as well as the market order, which will lead to the falling through of the securities market's function of realizing the optimization of resource distribution.Due to the late development of our country's securities market, very few studies of the manipulation of securities and the studies of laws and rules of securities have been made. In practice, manipulaition is very rampant and new changes have emerged in recent years. In China, there are many defects in making the laws to deal with the manipulation of securities, which can't meet the needs of dealing with the manipultion. Therefore, the study of the manipulating situation and the perfection of the laws will be of great thearetical and practical significance.In this paper, by taking the measures of case analysis, comparative analysis and logical analysis, I started in studying the manipulating situation, and analysed its causes. By reference to foreign advanced experience I put forword the thought, including company control, prevention system, law system, supervision system and the cultural constuction of stock market to perfect the laws to deal with the manipulation. This paper inquires into the new changes of manipulaton in securities market comprehensively and breaks the situations of former study which was just limited in the field of market rather than the field of company control ,and in the meanwhile, put forward a few views on the perfecting laws, supervision systems and the cultural construction of stock market.
