These researches are to provide the theoretic support to perfect the tendering and bidding system.Firstly by use of the theory of institutional economics reference the dissertation puts forward the definition and content of the cost of tendering and bidding with the feature of tendering and bidding in construction engineering. Secondly, the dissertation analyses the cost characteristics of tendering and bidding in construction engineering through researching the cost and the benefit of the tendering and bidding legal system in construction engineering and find that the tendering and bidding legal system is imperfect and the law conflicts seriously because the legislative cost is unreasonable. Moreover the imperfect matching systems and the"rent-seeking"activities result the high cost in the process of carrying out the law. These problems seriously affected the actual results of the bidding. Therefore, the cost which should be regarded as a standard for measuring the benefit of law is important for the tendering and bidding legal system in construction engineering. Finally, the dissertation provides a new research idea for studying the tendering and bidding legal system in construction engineering.
