Studies On The Legal System Of Supervision Of The Investment Of Insurance Funds

With the development of the economy,the investment of the insurance funds is getting more and more important to the development of the insurance industry and the economy.But the insurance industry in China is quite backward contrast to other countries,especially the legal supervision.So the appropriate cognition of the legal supervision system of the investment of insurance funds and the way to build the system accommodating to our own economic and political system is quite significant given the current circumstances.The essay is composed of four parts,the first part is the introduction of the theory of the legal system of supervision of the investment of insurance funds.Firstly,based on the concept and the feature of the insurance funds,the principal,which is determined by the feature of the insurance funds,governing the investment of insurance funds is presented.There is intimate connection between the regulatory objectives of the insurance funds and the principal of the investment of insurance funds,that the regulatory objectives of the insurance funds are extremely determined by the principal of the investment of insurance funds.The necessity of the legal supervision is also analyzed in this part by the discussion of the requirements of the industry development and the influence of the whole society.The emphasis is on the research and analysis on the legal system of supervision of the investment of the insurance funds in other countries and areas of the world in the second part. The cardinal mode is recommended,including the tolerant regulatory approach represented by Britain and the restrict regulatory approach adopted by the United States,Japan,and Taiwan district.Although all of the modes are accommodated to the situation of its own country,the advanced experience is worth learning.The third part is about the history of our country's legal system of supervision on insurance investment.By the conclusion of the features of the supervision in different times, the supervision mode can be divided into four stages.And the last part is the research on the problems which exist in the legal system of supervision in China and their solutions.In consideration of the features of the overseas investment of insurance funds and the defects of our own legal system,the writer gives some suggestions.
