Research On The Antimonopoly Problems Of Telecom Industry Of Our Country

According to conventional economics theories,the telecom industry was believed to be a typical industry of natural monopoly. Most of the Countries in the world run their telecom industry in form of monopoly and rigid control,except being suitable of antimonopoly law. But with the development of technology of telecomm industry, the monopolisitic attribute of the telecom industry has changed obviously. The following step is relax regulation reform in the telecom industry. Investigating the reform course of some developed countries, we can find out that the reform course always going with fetching in antimonopoly law.After the antimonopoly law is channeled into, it will conflict with already existed government regulation unavoidably. As to how to coordinate at this conflict, various countries formed different modes.The reform of Chinese telecom industry has gone through a process from regulation to relax regulation too. The near recombination influences the structure of telecom industry deeply,it make the chractor of multi-sides monopoly more outstanding. And this market structure brings abnormal market conduct, it also do harm to market performance.And the task to resist monopoly in telecom industry of our country is aggravated. At this moment, introducing the regulation under antimonopoly law which is more standardized into the telecom industry must be chosen.There are some laws about the monopolies in telecom industry,like Telecommunications Regulations, Anti-Unfair Competition Law and some department rules. They didn't determine their relations in applying them in telecom industry.The antimonopoly law in our country passed formally in 2007, but it is indeterminate that how to apply it to telecom industry.The most serious problem is there is a legislative blank about the relation and cooperation between of government regulation and regulation under antimonopoly law.On handling the relation of government regulation and regulation under antimonopoly law,we should use the advanced experience in the world for reference, set up the correspondence system of government regulation and regulation under antimonopoly law to resist the monopoly of the telecom industry more effectively. While establishing the correspondence system, we should seek the common goal of two sides, divide the work of two sides clearly.According to the developing stage of telecom industry,in initial stage,the government regulation should be exercised more frequently, and we should set up the goal of fair and effective structure of antimonopoly law progressively.
