On The Legal Status Of Securities Investor Protection Fund Company (SIPFC)

The emergence of SIPFC is a profound and practical thing in China, it will promote the development of securities market and will protect the securities investor so as to stabilize the order of the financial market in the future. The SIPFC is an newborn thing which needs development and improvement. Among all these problems about SIPFC, the legal status of SIPFC is the core and foundation. SIPFC plays a very important role on protection of small scale investor in case of the securities company is threatened with bankruptcy. This paper is mainly aimed at the legal status of SIPFC in order to find the universal and particular laws by means of analysis comparison.This paper falls into five sections. The first section is concentrated on the general introduction on SIPFC. The second section is limited to the legal quality and status of SIPFC. The third section is concerned with the procedure law about SIPF law system. The forth section is mainly on the question that analysis the role of SIPFC in case of bankruptcy of securities company. The last section's emphasis is on the legislative proposals about how to improve the SIPF law system. There are some research methods and research techniques are adopted in this paper, such as demonstration, analysis, comparison, historical analysis, and so on. This paper mainly based on the practice of the SIPF law system of China and benefit from other country's practice of law.
