Apprehension Of Corporate Social Responsibility In View Of Economic Law

Ever since the 20th century,companies develops quickly,which leads to a profusion of serious disputes,along with corporate develop increasingly and the social problem that it causes is getting serious increasingly.The social public put forward more and more protests and disaffection to corporate's pursuit of profits persistently,and finally,this cause the creation and development of corporate's social responsibility,and it becomes a hot problem discussed in all countries.Our country academia has some theories works and document,and based on admitting the corporate should undertake social responsibility,the scholars have reached an agreement on the basic consensus of the corporate's social responsibility,moreover,the previous researches have promoted the development of the theories.Generally speaking,however,this study is at an preliminary stage;opinions are diverse as well.We can analysize the responsibility from various courses,yet it is rarely discussed from the law,especially the economics law. This become the basic consensus to the basic content of corporate social responsibility already,the research result that already have promote the development of corporate social responsibility theory,but total to say,it is still very beginning to study corporate social responsibility,and still exists greatly disagree in many ways.And it has a lot of angle of view of discuss corporate social responsibility,but less of by the law angle, especially economic law,to analyze corporate social responsibility.In this paper,the author tries to do so,that study corporate social responsibility system from economic law angle,and it can be divided into four parts as follows:The first part is a summary of general theories on corporate's social responsibilities. This part investigated the origins and developments of the theory of corporate's social responsibility,analyzing the characteristics of corporate social responsibility,putting forward the author's own standpoint of corporate social responsibility's meaning and characteristics,summarized and introduced the analysis of theory at base of corporate's social responsibility carried out by other theory fields.All the above is the cushion for the next part to analyze corporate social responsibility from economic law angle.The second part is to discuss the basic theory of corporate's social responsibility from economic law angle,by contact the essence characteristic,faith and principle.The essence characteristic of economic law contain sociality,police and etc,the faith and principle of economic law contain the social basis,the nation intervention,the sustainable development,the balance and harmony and etc,which are all tremendously contacted with corporate's social responsibility,and provide the economic law theory for corporate social responsibility.Part 3,the contents of corporate social responsibility in view of economic law. Corporate should undertake social responsibility to corporate employees,consumers, environment and other aspects,follows the principle of responsibility,right and benefit unify mutually,freedom and orders unify mutually,social benefit and etc.Part 4 is to probe into the perfection of corporate social responsibility system in our country.We could make great efforts from the following aspects for the perfection of corporate social responsibility in our country:perfect and integration exterior related law of corporate social responsibility;change the government function;value the function of social agency organization;perfect corporate interior related system.
