Following with the development of modern information technology and network technique, E-bank comes into being, which is bringing more vigor to the development of modern economy and satisfying people's demands for convenient and efficient bank service to some extent. Electronic Funds Transfer of E-bank is one important link in the process of Internet bank business activities. It is defined as the Funds Transfer after the customer (including the bank) forwarding payment order to the computer network system supplied by the bank through electronic currency(including bank cards, digital currency, internet currency and electronic check ). Electronic Funds Transfer is distinguished from traditional face-to-face platform exchange with its feature of virtualization, digitalization and globalization, which is bringing new ways of efficiency growth for the bank and convenience to the customer, but also inevitably becoming the criminal of new problems and risk related with the law. The new risk caused by the particularity of the Internet, which is different from traditional ways of exchange faced by E-bank customers, can be considered as the main representation. Once this kind of things come into reality, the difficulty of rights protecting of the customer caused by the influence disproportion between bank and customer will pushing E-bank customers into an embarrassing situation. But there is no corresponding balance from forthcoming laws and regulations. Thus, rights protecting for E-bank customers is becoming a problem to be solved urgently.Coping with issue like this, the legislative experience of the American is advanced, and have a profound compact to other countries. Compared with these experience and practice, the incompetence of our regulation of E-bank customer rights is as follows:1.The legal hierarchy low;2The lack of relevant legislation;3.The value orientation of the legislation is biased;4.A vacuity of logic between the laws;5.The gaps between the law and the experience; 6.The massive incompletion in the construction of relevant systems.Thus,the choice of legislation model would depend on our domestic situations, attending the interests of the consumers ,and to be completed continuously.
