The Negative Economic Impact On The Implementing Countries For Misusing Anti-Dumping

The people usually believed that the goal of WTO and the predecessor GATT is to promote free trade.In order to achieve this goal,WTO/GATT has formulated a series of non-discrimination principle,and devoted itself to the world trade liberalization.Meanwhile,WTO/GATT has also formulated some suitable trade protection exceptions and trade relief measures and agreements,such as the anti-dumping agreement,the anti-subsidy agreement. However,the goal of any trade protection policies finally is in search of the realization of free trade.What a pity,when putting these policies into practice, the policies runs counter with the original intention,a good case in point is the anti-dumping policy.The definition of anti-dumping by WTO is cited by every member for the restraint of multilateral trading system on traditional trade barriers, making anti-dumping the most popular and frequently using tool.In fact, anti-dumping is misused in some countries and areas.Misusing anti-dumping means that because of defining the dumping by error,the country misuses anti-dumping,making the economy of the implementing country fail to be improved,the interest of some people be protected,the interest of the whole country getting lost.Every year,the number of anti-dumping increase quickly,most of which is out of repaying or protecting the interest of some groups,which is running counter with the original intention.As a result,the aim that protects the interest of the related industry and the whole country falls flat.The effect of implementing anti-dumping is bad,no matter for the implementing country or the being implemented country.In recent years,the team expands unceasingly,the situation has become even worse.According to the statistical data of WTO,China has become the major suffering country for 11 years,however,in another way,china has become top10 of the team which implements anti-dumping most frequently,so we had better study this issue in order to make good use of this tool.The article adopts mathematic method and economics model of supply and demand analyzing this issue of misuse on the basis of discussion on the current situation,the reason and the impact.The text is composed by six chapters.The first chapters tells of the background and significance of the problem,introducing the framework,the design of the text,and some definition,the second chapter are the review of relevant theories,applying the method of documents study in order to review and conclude these studies,which would be beneficial to my further study.The third chapter talks about the current situation and the original reason of the anti-dumping abuse.This chapter is one part of the main body,it studies the current situation and the original reason of the anti-dumping misuse to discuss the main issue by using the positive and theoretic method step by step.The fourth chapter studies the impact on native industry,FDI,the consumers,the downstream industry,the whole national economic for the abuse of anti-dumping,by using the positive and theoretic method,it analyzes the negative impact on the national welfare.The fifth chapter is positive analysis and case study.I try to take use of the change of macro-performance indicator and case study to discuss the limitation of the role played by the anti-dumping.The sixth chapter is policy suggesting,which is purpose of writing this article,I bring forward policy suggestion to our country on what we can do when is up against to anti-dumping,and how to implement anti-dumping more effectively.The creative point of this article runs as follows:firstly,selecting topic.I define anti-dumping as that because of defining the dumping by error,the country misuses anti-dumping,making the economy of the implementing country fail to be improved,the interest of some people be protected,the interest of the whole country getting lost.As many study were about the impact on the export country,I choose to select studying the problem of misusing anti-dumping from the view of implementing country,which is a challenge;secondly,the methods is multiplied,combining economic models and macroscopic analyses with microcosmic case analyses,which is one characteristics of the text.I take use of many different models in order to explain the problem in detail,aside by this,I try to testify the effect of anti-dumping for the implementing country by using the macro-performance indicator combing the mathematical analyses of situation with reason of misusing anti-dumping,meanwhile,illuminating the negative impact on the implementing country for the misuse of anti-dumping by proving macro-performance indicator not being improved and case study.
