The Conflict And The Coordination Between WTO Trade Policy And Competition Policy

With the developments of economic globalization and the trends of trade liberalization, private anti-competitive practices have become a major obstacle for trade liberalization.The issues about trade and competition policy under the framework of the WTO has become an important topic.And how to coordinate trade policy and competition policy has also become a consensus of the international community.However, because of the big differences on the issue of the position among all the members about the competition policy, with the result that we have yet to achieve greater progress.Nevertheless ,to build up the multilateral cooperation mechanism for competition is unavailable.Just under this condition, this article research the issues on WTO trade policy and competition policy , with a view to provide a basis for the future of our country in the WTO negotiations.The first chapter analyses the relation of WTO trade policy and competition policy.First I introduce their basic theories, then analyse their consistency and diversity as well as the interaction between them basing on the first analysis.Further,analyse the root cause of conflict and the possibility of co-ordination between the two.The second chapter introduces the competition policies in WTO.First,introduce the competition policies contained in existing WTO agreements, mainly in GATT, GATS, TRIPs and DSB.Next, analyse the results and the existing problems that the competition polices have been made.The third chapter analyses conflicts between WTO trade policy and competition policy.First,analyse the causes of the conflicts between the two in theory.Then, from the positive point of view ,combined with related WTO dispute cases, analyse the embodiment of the conflicts between the WTO trade policy and competition policy, as well as the resulting enlightenment.The last chapter interpret the co-ordination of WTO trade policy and competition policy. First, analyse the various coordinated modes on competition policy in the trading system to come to their own advantages and disadvantages.And then put under the co-ordination patterns about WTO trade policy and competition policy and analyse that,from which lead to problems about the co-ordination of trade policy and competition policy under WTO.Based on the above analysis of the results,choice the final model of co-ordination,and then issue personal recommendations covering coordinated manners,the content of coordination and so on.
