With the tendency of economic globalization, the investment flows between countries is unceasingly growing. International investment between countries becomes so frequent that the legal environment of international investment is put forward new demands to. However, there is no a comprehensive, unified multilateral investment agreement。Under the situation, bilateral investment agreements become the main melody among international investment agreements. Since China and Sweden signed the first bilateral investment agreement in 1982, China has signed 110 bilateral investment agreement by 2007. Under the new tendency of international investment agreements and" bringing in" and "going out" strategy of today in China, there is an urgent need to research bilateral investment agreements between China and foreign. The dissertation in question, taking Bits as its study subject, is composed of five parts, the main contents of which are as following:Part I : Overview of the bilateral investment agreements. This section is composed of the evolution of BITs, features, functions and the international development trend. The comprehensive analysis about the functions of BITs is combined with BITs between China and foreign. During the part about the tendency of BITs, the author intends to research innovative taking the BIT model of America as example.Part II: Analysis of present state between China and foreign. This part composes two aspects of the analysis. First, the author the carry out analysis about features of BITs between China and foreign in the early 1990s.Then, the author go on to study the new changes, which is composed of investment and investor, investment treatment, expropriation and compensation and dispute settlement.Part III: The reflection in content of BITs between China and foreign. This is the main part in the article. On the basis of analysis in content of BITs, the author Point out problems in BITs, such as scope of the investment, treatment of investment, expropriation and compensation, dispute settlement.Part IV: Suggestion of improvement on Chinese BITs in the future. The part is the end of dissertation. The author offers some suggestions for problems and tendency existing in BITs between China and foreign.
