Hearing System In Urban Planning

Hearing system has become one of the Administrative Procedure Act, and its essence is to listen to the views of the parties. Administrative hearing as an important design is the restrictions on executive authority which exercises public power, it will have a very far-reaching impact in the democracy of the whole society. In the 1990s, hearing system started from Shenzhen City. Although no specific operational system, with the social progress and enhanced sense of democracy, the hearing system and the concept was recognized by growing public, also began to expand the scope of the use. The urban planning has great impacted on China's socialist construction and urban development, and has become a important administrative decisions directly bearing on the immediate well-being of the general public and the living environment, so application in urban planning programs can improve the legal system of China's urban planning , the conversion from theoretical value to real value has a very practical significance. At present, the field of urban planning at the application hearing system has a lot of examples, but the hearing system which is no normative and systemic is not perfect. Construction of the hearing system will bring about the value of hearing, and the value of the hearing system is closely related to whether it is reasonable. To construct a reasonable hearing system and to realize the value of the hearing, we must deal with the contradiction between justice and efficiency, make fairness and efficiency achieve the best combination. In order to regulate the hearing process, and to promote the value of hearing system implementation, efforts should be made in three aspects: Firstly, Changing concepts, creating a democratic atmosphere which are the foundation to build and implementation of the hearing system, realizing the value of hearing; Secondly, we should improve the entire legal system, set up epistatic law, provide a legal basis for the hearing system; finally, it is necessary to construct a reasonable hearing system, which is the key to achieve the value of the hearing.Article is divided into three parts. The first part is the introduction of the basic concepts, including the principles and values of the hearing system, which leads to that urban planning process should be introduced into the hearing system. Then we analyzes the feasibility and the inevitability of the hearing system of urban planning. Hearing system can improve public participation, change the functions of government departments, and promote openness and transparency of government information.Part II analyzes the current problems in our country and foreign urban planning hearing system with well developed countries , for example, the United States and the United Kingdom.Mirrored the experience of comparatively improved city planning and management system abroad, according to the status quo of city planning and management in our country, the last part has offered some practical propositions suitable for China and for its future development of administrative hearing in city planning.This paper proposes the establishment the hearing system in urban planning. We should listen to the public views, and ensure the healthy development of cities. Hearing system is the core of administrative procedures. It making the Government exercise executive powers according to the law, is now an important symbol of democracy.
