Employment discrimination is a well concerned social problem, as every social man will start a career, and therefore will face all kind of employment problems. Employment discrimination can be divided into many types, such as gender discrimination, stature discrimination, age discrimination, household registration discrimination, regional discrimination, etc. It means the employee is excluded in some respects, and therefore be treated unfairly or unequally.Deeply influenced by the urban-rural dual organization, new character appears in employment in the transformation period:caused by the transformation of state-owned enterprise and reform in government organization, recruitment double-track system takes shape, dual employment institute becomes more and more popular, certification becomes much more harder to get, the phenomenon of unequal pay for equal work becomes intensifying, a new type of identical discrimination emerged. Identical discrimination means the phenomenon of unequal pay for equal work caused by different labor relations. In the employing unit, especially in government, public institutions and state-owned enterprises, there is wage and insurance difference between employees with different grade, certification and identity. It is a mass discrimination or labeling discrimination, performing as divide employees into in-group source and outsider, with and without certification, conducting unequal pay for equal work.This article defined the concepts of employment discrimination, recruitment double-track system, equal pay for equal work, identical discrimination, etc, and analyzed their relationship. In the background of economic transformation, the identity becomes more and more important, and the phenomenon of unequal pay for equal work becomes more and more obvious. In this article, we use 5 cases to explain its universality. And summarized the jeopardizes:violate the labor's legal right, hurt there working enthusiasm, imbalance the justice and performance, and hurt the social fair and just. And traced its source:left problem of planning system, support by the stockholder concerned, the situation of Chinese labor market, etc. And, at last, put forward the reform proposals:keeping deepening the reform of state-owned enterprise, changes the model of personnel management, operationalize the relative laws, strengthen the execute and supervision of, seek for effective salary system, cultivate the labor's right-safeguarding consciousness.This article focus on two issues:one is to answer the relationship of recruitment double-track system and unequal pay for equal work, the other is to make clear that unequal pay for equal work is a type of identical discrimination. Unequal pay for equal work is not only an inequality of salary treatment, but also a political inequality of vocational development and rights, moreover, it's a social discrimination caused by different identity. This provides a new viewpoint for the employment discrimination research.
