Asymmetric Control Research In China Telecom

The Ministry of Information Industry and National Development and Reform Commission, Ministry of Finance jointly issued "Notice on Deepening Telecommunications Reform" on May 24th,2008. The notice clearly stated that we should "strengthen the supervision of the telecommunications industry for the new market structure after the reorganization will take the necessary measures to promote the balanced development of the industry structure, establish and perfect the corresponding regulatory regime. "This is the first policy about asymmetrical regulation in the telecommunication industry in China.The author started from the roots of the theory of asymmetrical regulation, explaining the basic theory of government regulation in the modern West, using the research methods of the comparative analysis and theory into practice, and discussed the definition, concept definition, characteristics and function of asymmetrical regulation and the relationship between the asymmetrical regulation policies and anti-trust.The author also analyzed the asymmetrical regulation policy which had been adopted in history and the argument about the asymmetrical regulation policy; introduced the experience of foreign asymmetrical regulation, elborated the asymmetrical regulation and the process and the basic standards of SMP in EU, presented the experiences of the asymmetrical regulation in United States, South Korea, Japan and Korea. At last, the author summed up the experiences inspirate for China.In discussing the asymmetrical regulation in telecommunication industry in our country, according to collecting the large amounts of material, data, analysis of the current telecom market structure and competition pattern, the author proposed the necessity of adopting the asymmetrical regulation policy in China. And the author also discussed the pattern of government regulation, analysis of supporting regulatory policies and put forward some suggestions about carrying out the asymmetrical regulation policy at the present stage in China.The innovation in the theory lies in combination of the theory and the practice to make a preliminary study of asymmetric regulation in telecommunications industry.On the basis of the experience of foreign countries and fully considering the reality of our telecom's market, the author put forward the principle and ideas of the asymmetrical regulation and some advise of establishment of asymmetrical regulation under the current circumstances. For achieving targets of the government regulatory departments to implement it, this thesis has a certain degree of theoretical and practical application value.
