On The Deficiency And Legislative Improvement Of Public Participation Mechanism In Environmental Protection In China

In recent years, the factors like public lack of environmental knowledge and environmental concepts backward result in many problems in the mechanism of public participation in environmental protection in China. People generally consider that environmental protection is the adjustive functions of government and market, however, the happening of government failure and market failure break the fantasy of shirking the responsibility. Public participation in environmental protection is just the effective means to overcome the dual failure. The mechanism of public participation can not only overcome the dual failure,but become a powerful way to achieve positive dialogue between the public and the government, plays actual role in promoting the development of environmental law. In the face of many problems like environmental decision-making opaque, environmental protection NGO useless and other issues,we should actively learn from the experience of foreign developed countries and formulate the corresponding improvement measures, such as improving the environmental information disclosure system and so on.
