| The mining resource is the most important support to the economic and socialdevelopment of our country on the ground of the resource leading developmentalmodel. But the mining is a high-contaminated industry, and the recent large-scaleexploitation has arisen a series of serious mine environmental problems. Mineenvironmental reclamation and resumption mechanism must be established.Firstly, this paper uses two cases to introduce the environmental problems whichled by mining, and analyzes the causations of the mine environmental problems andthe actualities of the research and the execution of the law. And then the paperintroduces the mining property and the environmental administration system in othercountries, and on this basis, analyses, compares and conformities the relevant legalsystem of mine environmental problem and its implementation of those countries. Thepurpose is to extract good experience and construct our mechanism of mineenvironment resumption and reclamation.On the basis of the analyses upwards, the last portion is the construction of themechanism of the mine environment resumption and reclamation in our country. Thebasis of a perfect mechanism is composed with well property right system andeffective administration. And steady-going financing and the mine corporation'sconsciousness of fulfilling the environmental protection duty ensure the function ofthe mechanism. The core legal system of the mechanism of mine environmentreclamation and resumption should run through the whole process of the miningexploitation: form the environmental protection and resumption planning system,mining environmental impact assessment system, and the competent department'smonitoring, to the supervision and management system and the reclamation to themining land and the resumption to the environmental factors. We should not only payattention to the design of legal system, but also more emphasize the maneuverabilityof the implementation, and strive for higher social benefit with lower legal cost. |
