Study Of "drunken Driving Offend" Listed Into Our Criminal Law

With our rapid social and economic developments, family cars have multiplied to a surprising level. As a result, traffic violations due to drinking become very common in nowadays. All walks of life pay extensive attention to it because it constitutes an extremely urgent threat to human's life, health and property. This phenomenon has become a prime focus for hot topics and disputes. Especially the fatal accidents initiated from driving while intoxicated trends to a rapid increasing direction. But conviction and determination the penalty from our court is nonstandard. The legal theorists and judiciary practices hesitate between "the traffic offends" or "harm to public safety", and it has aroused a lot of controversy. In addition, whether we should determine different penalty according to the amount of compensation from the traffic offender's family involved a serious problem, our evaluation principle. This paper dwells on the drunken driving behaviors and proposes a separated "drunken driving offend" listed into our criminal law after a detailed analysis. Considering the necessity and feasibility, I put forward the improving suggestions.
