This equivocal provision is contrary to the evolutive concept of modern legislation and make against judicial practice, consequently impede the socio-economic development.Motive of writing this article rooted in attention to nature of the requesting right and requesting right of restoring inheritance. The author believes that a good many theory about requesting right of restoring inheritance are not unanimous owing to non-uniform cognizance for the nature of requesting right of restoring inheritance which ties up with the nature of the requesting right and heirdom. Theoretical focus of the study of this paper is the nature of the requesting right, inheritance and requesting right of restoring inheritance. Logical starting point for argument are proposal of the concept, function and interpretation of the development about requesting right of restoring inheritance.Then the author made dialectical analysis of function and development of requesting right of restoring inheritance.Furthermore,the writer synthetically survey legislation of the main civil law countries and regions, combined with our legislation, illustrated the shortcomings of our legislation ,and then proposed a modified advice. In addition to the introduction and conclusion of this article, the body consists of four parts.Preamble pointed out deficiency of our protection system of inheritance rights, and then illuminated momentous significance of definitely stipulating requesting right of restoring inheritance in China's mainland. The first chapter described concept, development and the role of requesting right of restoring inheritance. The second chapter analyzed the nature of requesting right of restoring inheritance. The author adopted the systems theory research methods to identification of its nature.Scilicet the study of the nature of requesting right of restoring inheritance based on analysis of the nature of the requesting right and heirdom. Further more, the author always carried out a dialectical thinking in affirming the nature of the three. Chapter III studied qualification and performance of requesting right of restoring inheritance. The fourth chapter analyzed relevant legislation of Germany, Japan and Taiwanand other countries and regions,and then pointed out the deficiencies in our legislation and made a comprehensive proposal.
