Study On Crime Of Accepting Bribes By Power Of Influece

In 2009, the legislator enacted the amendment of Criminal Seven; the article 13 is ill-used bribery in influence. This crime is fighting against for corruption, and all of the society hopes that it can stop corruption in every field. But, under the principle of criminal law, all of the sentence should be made under the Criminal, which is principle of legally prescribed punishment. This article will discuss three parts:The first part is the introduction of ill-used bribery in influence. In my article, this crime is that the person who has relationship with nation staff bribers for unfair interest.In part two, this article discusses the constructions of ill-used bribery in influence. The object of this crime is complex object, the first part is the justness of official duty, and the second part is the fairness of competition. The object aspect includes two parts, one is that relationship of national staff briber from others and receives or asks for interest, and the other is that the retired national staff or his relationship does the same action. In the subjective aspect, one always direct intention does ill-used bribery in influence, and never indirect intention does that.In part three, this article discusses some practice issues. One of the most important things is how to distinguish the bribery and the ill-used bribery in influence. Then this article introduced some apartment about how to despair bribery pander from ill-used bribery in influence. At last, ill-used bribery in influence is different from fraud.
