As the most developing nations of absorption of foreign direct investment (FDI), china is still the type of resources consuming economic development mode, less reliance on technology and scientific & technological innovation capability is below average quality. In this case, how to establish our international measures of the intellectual property rights protection system according to the present level of development direction of development, drawing on the advantages and avoid disadvantages for our better utilizing and absorption of foreign investment, promoting of technical progress and our economic development.The article use the Ginarte-park index for measuring the intensity of our legislation on intellectual property rights of the indicators, judicial protection, administrative and economic development and international monitoring checks four aspects of our strength in intellectual property law enforcement measures, to establish the intellectual property rights protection standards with the product of the strong intensity of legislation and enforcement. At first, the article use foreign direct investment data from 1993 to 2008 of our country, the amount of actually FDI as independent variable, market factors, trade openness, cost factors, buildup effect and protection of intellectual property rights policy five influence on foreign direct investment area distribution choose factors as its independent variable, to have a linear regression, and come to the conclusion that china's intellectual property rights protection promote to the absorption of our FDI. On that basis, we have a linear regression of the eastern the central and western region respectively. We concluded that the standard of intellectual property rights protection could be further promote the local absorption of FDI, but on the contrary, the western regions with low level of protection of intellectual property rights can be more conducive to the local absorption of foreign direct investment.
