Research On The Influence Of Intellectual Property Protection Level On Foreign Direct Investment In China

Nowadays,the wave of globalization is inevitable,and the international intellectual property protection also embraces new changes.Especially after China's accession to the WTO,the economic development gradually realizes the world integration,which brings great challenges to China's intellectual property work.Intellectual property is not only an important way to improve the core competitiveness of enterprises,but also an important manifestation of a country's strong science and technology.Its importance is increasingly valued by the government and enterprises,and whether intellectual property protection can attract foreign direct investment has increasingly become the focus of research.The level of intellectual property protection is related to the development and progress of a country's technological innovation,and it will also affect the quantity and quality of foreign capital utilization to varying degrees.Some believe that improving the level of intellectual property protection has a positive impact on the inflow of foreign capital,while some hold that the high level of intellectual property protection hinders FDI from different perspectives.In addition,some scholars believe that the relationship between the two is uncertain and restricted by many factors.Drawing on the research conclusions of previous scholars,this paper,based on the theory of international direct investment and represented by the OLI theory of dunning,explains the relationship between three advantages and intellectual property rights,sorts out the three different effects of intellectual property protection on FDI,and tries to explore the possible positive correlation between them as deeply as possible.Based on the fact that 29 provinces in China have received and utilized foreign direct investment,we can judge whether the improvement of intellectual property protection level will have an impact on them.This article selects widely adopted and approved by the GP index to measure level of patent protection legislation in our country,at the same time,on the basis of li-min yao,Rao Yan study to join the law enforcement level metrics,corrects the measure methods of intellectual property protection level,eventually to build index system of regional intellectual property protection level,the need to fully consider the realistic national conditions,calculates various provinces and cities autonomous region from 2000 to 2016 in our country's actual level of ipr protection.The results show that the level of intellectual property protection in China's 29 provinces and autonomous regions shows an uneven trend,and the level of intellectual property protection in economically developed provinces and municipalities such as Beijing,Shanghai,jiangsu and zhejiang is significantly better than that in economically less developed provinces and municipalities such as yunnan,ningxia,guangxi and guizhou.In chapter 5,quantitative empirical analysis is carried out,and a regression model is built with other relevant data of 29 provinces and cities to explore the impact of the improvement of intellectual property protection level on the acceptance of actual foreign investment in each province.The empirical results show that there is a significant positive correlation between intellectual property protection level and FDI.In chapter 6,the author believes that to improve the level of intellectual property protection,China must strengthen the work of intellectual property protection,from the legislative and judicial aspects to provide institutional protection for intellectual property,comprehensive coordination of regional development,narrow the development gap,so as to promote the economic development of the whole country and the progress of scientific and technological innovation.We should give policy preference,guarantee mechanism,learn to make use of TRIPS international rules and adjust FDI mode in time,put forward relevant policy Suggestions on intellectual property protection in China,and make scientific and effective use of foreign investment in opening to the outside world.
