Bundled Patented A New Type Of Technical Barriers To Trade And Its Countermeasures

After China's entry into the WTO, the Chinese enterprise hasencounter TBT while enjoying the benefits of free trade. This articleplaces emphasis on the discussion of the Patent Standard as well as on theeconomic analysis of the trade barrier resulting from the Patent Standardand resolving police thereof. The emergence of Patent Standard is theresult of the development of technology and Patent Standard itself is alegitimate standard. Once the patent was combined with the standard,exertion field of patent was enlarged into the exchange field since thestandard has the regulation function. Then this article makes theeconomic analysis from the patent and productivity aspects respectivelyand derives the impacts that the Patent Standard brings on theinternational trade. The Patent Standard has become a new trade barrierand hindered the foreign trade of the underdeveloped countries. Anddifferent from the conventional standard, the Patent Standard encountersthe risk of being abused, which will do harmer to the international trade.This article also applied an empirical study by analyze the relationsbetween a country's patent number and its export value and concludedthat they have strong related. In order to prevent the bad results from thestandard abuse, even to break through this trade barrier, the most effectivesolution is building up self-owned intellectual property besides seekingfor legal protection.
