Since "Doha Development Agenda" is being at a stand,the development of multilateral trading is seriously retarded.Many countries thus take measures to adapt the foreign trade policy,turning their steps to the regional economic cooperation.Among them,the Bilateral Free Trade Agreement (FTA),based on the fundamental incumbency of WTO,of quality of being attainable and widely-included and so forth,are favored by the countries. More and more countries attach great importance on the tactic of signing the bilateral FTA,and during the booming trend of global bilateral free trade,they do benefit from bilateral FTA to promote domestic economic growth, overcoming the encumbrance of multilateral trading system.Nevertheless,by far,China has contracted seven bilateral FTA,and among which only two are directed to the sovereign states:"China-Paskistan Free Trade Agreement" and "China-Chile Free Trade Agreement",and the motive of the former is mainly politics-oriented.Accordingly,the bilateral FTA process of our country is comparatively unenlightened.As a trading state,China should not be cast off the bilateral free trade system,but to conform to the trend,greatly involve into bilateral FTA instead.Concerned of the wide spread of bilateral FTA,a critical eye of jurisprudence is of quite important meaning in guiding bilateral free trade's development in china.We need merge into the trend of bilateral FTA as soon as possible.In order to make it a positive factor of stimulating our economy, we have to adopt other countries' experience and knowledge to establish and fulfill our own system.This article will use demonstration,comparison,history and deduction to elaborate bilateral FTA system.It is divided into 5 parts.The chapter 1 is the general knowledge of bilateral FTA.Besides the concept of bilateral FTA,its characteristics,rules and running mechanism have also been covered.This newly bilateral FTA,which is based on the basic obligation of WTO,is not a spoil of WTO,but a complementation.An introduction has been given to the origin,development and future growth of bilateral FTA. Chapter 2 is the depiction of the relationship between bilateral FTA and WTO.First is the WTO rules based on explanation of the existing basis of bilateral FTA in multilateral system.Most importantly it covers the 24^th section of GATT,"24^th section of GATT Interpretation Understandings",the 5^th section of GTAS,and "right licensing documents of developing countries" to prove its legal basement under the WTO-leading multilateral trade system. Then,bilateral economic unification and economic globalization have been used as the cut-in point to analyze the conflict and coordination of bilateral FTA and WTO.It proves that alike bilateral economic unification and economic globalization,bilateral FTA and WTO is also in dialectical unity relationship.The chapter 3 focuses on the introduction and analysis of the bilateral FTA scheme.And then the bilateral FTA is classified into the south-to-south bilateral FTA,north-to-north bilateral FTA,and south-to-north bilateral FTA from the view of the present south-to-north confrontations of the world. Besides that,the characteristic scheme of the each agreement is introduced.At last,the introductions and annalysis of the present bilateral FTA scheme on goods trade,services trade,investment measures and other relevant schemes are made.In chapter 4,the truth analysis is used to analyze the system of the"Chile-Canada Free Trade Agreement" and "Mexico-EU Free Trade Agreement".The system and arrangement of the "Chile-Canada Free Trade Agreement" are pointed out to follow by the NAFTA on the basis of the introduction to the signing of the agreement and the arranging of the system, which is referential to the signing of bilateral FTA between China and ASEAN countries.At the same time,China should also imitate the environmental protective system in the "Chile-Canada FTA" and pay attention to the environmental protective system concerning trade in the process of the bilateral free trade.The "Mexico-EU FTA" is the typical one in north-south form on the basis of the introduction to the signing of the agreement and the arranging of the system.It may firstly inspire China on the guiding thoughts; secondly,the gradual open mode is suitable for developing countries,which has positive reference to China.Chapter 5 is based on China's reality to state the importance of bilateral FTA for China.Second part is the introduction of China Bilateral FTA system. As Chile is the first sovereign country to sign bilateral FTA with China, "China-Chile FTA" is evidently significant.Third part takes the "China-Chile FTA" for example to point out the drawbacks of China Bilateral FTA system and China's countermeasures.
