| Land expropriation system in china takes form the planned economy time,which is an important policy in that it coordinated industrialization of the country and took a positive role in boosting development of national economy."The present period" refers to the time of the middle—post of China's industrialization,which is based mainly on the scientific development put by the 16th National People's Congress.With the perfection of China marketplace economic system, the present land expropriation system has not adapted the demand of the marketplace economic system and its inherent defect has been becoming more and more serious.Based on the research on the rural collective economic property fights,the public interests,the standard of compensation and the procedure of land expropriation,this paper analyses the defect of the present land expropriation and its cause and then put forward the scheme of″double-track system″,which is based on the lessons of land expropriation of foreign country and China's Hong Kong and Taiwan,and on reality of current Chinese economy society,which demands the government break the administration monopoly of first-degree land market and allow rural collective land to enter land market directly reserving rural collective land proprietary rights.To improve collective land expropriation institution,this paper puts forward the following advices:(1) explicate the scope of public interests;(2) improve and perfect the system of land property,explicate the owner of rural land property right,put into use of the strictest cultivated land;(3) achieve the equity between the rural collective land and the state-owned land,and the fact that the land property,the land price and land property right are the same between the rural collective land and the state-owned land;(4) combine the city land market with the countryside land market,which allow the market mechanism to play basic role in land price formation and land allocation of resources. |
