The Perspective Of Industry And Commerce Administration, Punishing And Preventing Acts Of Unfair Competition,

With the development of the socialist market economy in China, it has become more important to keep the market competition order and protect its fairness, of which, as the government law enforcement department, Administration for industry & commerce has responsibilities, and to protect the legal rights of customers and coporates. How to explore an effective way to against unfair competition and prevention mechanism is not only the way of improving administrative efficiency, but also the demand of legal administration and people.Based on the working practise, the paper is consisted of five chapters, of which the framework is as following: Chapter I is about the basic definition and theories of fair trade law enforcement, which consists of fair competition theory, prevention and administration theory, law enforcement theory. On the currency of the law enforcement department and its achievements, Chapter III points out the contradictions and chanllenges it faces and analysis the reasons. Chapter IIII and V mainly discusses the policy and legislation of proventing the unfair competition, so that the law enforcement of administration for industry & commerce will be more executive. On the other hand, it is important to construct the prevention mechanism of unfair competition, with the help of coporate credit database, penalty measures and self-disciplines, which will help to change from passive to active prevetion, from individual case dealing to social wide transition, from punishment mainly to prevention mainly, in order to standarize the functions of administration for industry & commerce, promote the effeciency, and make greater contribution to the healthy development of district market order in the field of fair trade law enforcement.
