Intellectual Property Rights In China And South Korea Trade

In the 20th century, the political system was as the center of the international order system, but after going into the 21st century, the intellectual property is the core system of the economic system. Based on this, in the development of international trade the international technical trade which is based on the intellectual property rights continuously has been increased its important roles.Since the core of competitiveness among countries had been switched from capital in the past to the technology, the competition between countries is getting fiercer and fiercer, the success and failure of the science and technology in the international community is the key elements which one nation's future can be determined by.In the situation that the technical factors are regarded very important in the international community, in order to preparing the foundation to export their technology, developed countries are trying to derive the new intellectual property through the new products R&D as their new technology.Those intellectual property rights and the core of the intellectual property in the international community are increasingly highlighted their importance, in these situation China and Korea, both countries also have lots of effort to the strength of intellectual property rights for the development of international technical trade. Since China and Korea had formed a friendly relationship in August 1992, both countries'technology exchange and trade have been increasing every year. However, South Korea has an enable to the technology exports and the application of the intellectual property rights to China, on the other hand, China still has the passive position to South Korea for ensuring the intellectual property and the technology exports.This paper would studies the current and future confrontation in both countries as analyzing the status of China and Korea's technology trade and comparison.The scholars who have the interests in the international technology trade are increasing day after by day, also the research about the intellectual property rights based on the technology trade is growing. Nevertheless, the comparative studies a bout the technology trade and the effect of the intellectual property rights are still imperfective, or are limited to being vitality of technology trade and protection of the intellectual property in own country.The aim of this paper is to analyze how the intellectual property rights has an influence to the technology trade between China and Korea, mostly focused on the comparative analysis about the China-Korea's intellectual property trade and China-Korea's exchange status. First, through the basic technology trade theory and development process of the China-Korea technology trade, this paper would state how the technology trade can have an effect to both countries'industry structure since formed friendly relationship between China and Korea, also would be mentioned the difference of the technology trade policy between China and Korea. And then, would analyze the positive and negative effects how the intellectual property has an influence to the China-Korea's technology trade. Finally, this paper would refer to the China-Korea's policies on the technology trade and conclusions.
