| The protections of Intellectual Property more and more become the focus in international trade. And with the establishment of TRIPS by WTO, it becomes an international trend. How to combine the intellectual property protections with international trade is not only what the trips focus on , but also most countries care about for good of their owns. It is of significance for China to learn from countries that have rich experience on trade-related Intellectual Property protections based on China's present situation.This paper is trying to solve two questions: First, why should the Intellectual Property be protected in international trade? Second, how should the Intellectual Property be protected?The first half of this paper illustrates the importance of Intellectual Property protections in terms of economics and trade, which set up theoretical foundations for Intellectual Property protections. The rest analyzes the legal practices of TRIPS and some typical countries on Intellectual Property protections and finally put forward with some countermeasures which are beneficial to China's trade.Developed countries often abuse on Intellectual Property in international trade. TRIPS have related clauses to restrict the abuse of Intellectual Property, and allow every member to make civil law to deal with these issues. So it is quite a good opportunity for china to make use of all those restrictions on abuse of Intellectual Property on behalf of China's trade. |
