BackgroundMedical tangle, broadly speaking, refers to the conflicts of the patients and their relatives with medical institutions and their staff in the course of medical treatment, as well as the general civil tangle caused by some non-clinic care. After 1990's, medical tangle has grown rapidly and continually. Report of the General Office of the Ministry of Health on the issues concerning the Petitions and Visits by health administrative departments informed that the contents of the most visit was medical tangle, it accounts for 49.47%. Since 2003, the survey of Shanghai Municipal Health Bureau showed that medical tangle had arisen from 11.7% to 18.8% annually. During the year 2008 to 2009, Zhabei Medical Malpractice Administration Office had received 924 medical tangles. Solving and handling the Medical tangle fairly and correctly is becoming a hot issue for building a harmonious doctor-patient relationship. And it is very important for maintaining the social stability.ObjectiveThrough we survey the status and solution of medical tangle in Zhabei District, we analyze the causes of medical tangle, the advantages and disadvantage of negotiation and mediation for resolving medical tangle. And we can propose suggestions to improve the negotiation and mediation mechanisms. Then, we can improve health care quality and build a harmonious doctor-patient relationship.MethodWe take the medical institutions of first, second, third degree and Medical Malpractice Administration in Zhabei District as the research object. By the system of monitoring medical tangle of Shanghai Municipal Health Inspection Administration, we comb of all the medical tangles in Zhabei District from 2008 to 2009. The conclusion has been drawn from literature review, qualitative analysis and semi-quantitative analysis based on the statistic yearbooks. We can analyze the status and solution of the medical tangle in Zhabei District and discuss how to improve the resolution mechanism of medical tangle, so that we can provide suggestions for that. Results1. In Zhabei District, it shows that medical tangle concentrated in the medical institutions of third degree from 2008 to 2009. And the medical complaints focused on the health care quality.2. Improper surgery and medicinal treatment were the focus of medical tangle complaints. We should strengthen the inspection for the relevant departments.3. As the main form of handling medical tangle complaints, negotiation and mediation has approved by both doctors and patients gradually.4. The legal system dealing with medical tangle exists insufficient. We need to improve it constantly.5. Health administrative departments should strengthen the Medical Malpractice Administration and make their staff cultivated.6. The awareness of the staff in medical institutions of patient safety and the humanities needs to be improved.ConclusionProfession, restriction and risk of medical care, social factors, as well as patient factors and so on, cause medical tangle and complaints occurred. Finding how to deal with medical tangle is practical for maintaining patients'rights and building a harmonious society. In Zhabei District, the non-litigation ways such as negotiation, mediation and so on, have become the main form to solve medical tangle. It helps to ease conflicts between doctors and patients, to handle medical tangle more efficiently and economically. But the key to reduce medical tangle is to improve health care quality. Therefore, we must enhance the management of medical institutions, the awareness of law practitioners, and the humanities of the staff in medical institutions.
