Employment discrimination has always been a widespread problem faced by the economic and social development around the world. Everyday, in the working area, lots of discriminations in different forms will happen. Tens of thousands of people are suffering the discriminations just because of their sex, religion and skin color. How to eliminate employment discrimination has become the common concern by States and the International Labor Organization. In 1958, ILO adopted the Discrimination (Employment and Occupation) Convention; it is the earliest work on the Elimination of all forms of discrimination and to promote equality provisions of the policy framework. Member States of the ILO should make a commitment to declare for the promotion of compliance with employment and career opportunities and equal treatment of equal national policy to eliminate discrimination in employment and occupation. It undoubtedly has a great impact on human rights protection, elimination of employment and occupation discrimination, promotion of labor's creativity, social and economic development, also the world civilization.According to the convention, The U.S, U.K has established a relatively complete domestic legal system for the elimination of discrimination in employment. Although Japan did not unify anti-employment discrimination legislation, it formed its own basic framework of that. The anti-discrimination legislation of the above three nations is worthy of study and for reference by our country.On 2006/1/12, China ratified the Discrimination (Employment and Occupation) Convention. That action specified the obligations for the elimination of discrimination in employment meanwhile it boosted the pace to establish and improve the current legislation and relative system in China. Considering lots of defects in the current legislation the first and foremost is to improve the domestic legislation system.
