Legal Professional Groups And The Rule Of Law Modernization

The legal professional community refers to a special social group including the judges, prosecutors, lawyers, jurists. It is a professional, independent, homogeneous, monopolistic knowledge community with a common law knowledge background, a stereotyped thinking mode, and a common legal language, which has received legal education and special vocational training. The law modernization refers to the historical transformation process from traditional to modern. In the perspective of the connotation features, the law modernization is a process including the fields of the legal thoughts, behaviors and practice fields with the core of the modernization of humans. The legal modernization process is not only the improvement and development of the rational system, but also depends on the display of the main function of the legal professional community. Whether the enthusiasm, initiative and creativity of the legal professional community can be displayed will decide the trajectory and direction of the rule of the law.By using a comparative analysis method, this paper selects some representative countries of different legal system, including the United States, Britain, Germany, China, etc, studies the different effects by the foreign judges, forensic scientists, lawyers for its legal construction, followed by a comparison and analysis of the effects of Chinese judges, lawyers and jurists. So far, China is a country gradually stepping to the law modernization. The legal professional group has played a positive role in the law modernization of our country, however, because of many of its shortages, it has represented the limitations which has hindered the process. The innovation points of this paper is to discuss the situation and deficiency of the Chinese legal professional group, through a comparison and summary of the developed countries, in the hope of promoting the construction of the legal professional community and the law modernization of China.
