On The Cultural Construction Of Lawyer Profession Under The Rule Of Law

The conception of rule-of-law includes the nature, objective, structure, functionand value of rule-of-law. It reflects people’s knowledge and conviction. The lawyers’culture reflects the character of lawyer profession during lawyers working. It believesin rules, rights and pursuits interests. It also believes that lawyers should deal withcases independently. The cultural construction of lawyer profession is a necessary partof ruling of law. And the value of lawyer requires that too. Chinese modern lawyers’culture rooted from the red base area, began in the state-found age, and developedafter the16thNational Congress of the Communist Party of China. Its flourishing areacoved the developed city firstly. As a whole, our Chinese cultural construction oflawyer profession has gotten a rapid development. But there are still many problems,for lacking necessary economic foundation and tradition, especially for the mode ofthinking that society leaded by political power.The Chinese Judicial Department and Chinese Lawyer Association put forward aplan to establish a Chinese characteristic culture system of lawyers, which containsthe principle system and the practice system. The principle system is the foundationof the culture system. The principle system should show the definition, the characters,the function, the content structure and connection to the related society factors. Thepractice system is the extence of the theory system. And it should settle problemsconcerning how to establishing the institutions, how to standard the lawyers’ behavior,how to raise the lawyers’ spiritual level and how to evaluate the above measures.Background our rule-of-law practice, to study cultural constructing of lawyerprofession not only can deepen our understanding, but also it’s a practical problem.We study it and we are seeking a better way to resolve the practical problems.
