Criminal Proceedings In The Witness Protection System

In criminal proceedings, the testimony of witnesses is one of the evidence which is widely used, and is playing an irreplaceable role for the facts for the identification of their cases. Witnesses are related to the effective implementation of substantial and procedural justice and the way of judicial reform. To protect witnesses'attendance, first is to eliminate witnesses' psychological fear which is needed to develop a comprehensive and specific witness protection system. Author started the exploration of the issue from the main problems in our current system of witness protection in criminal proceedings.The whole paper consists of three parts, namely introduction, the body and conclusion. Introduction mainly introduces the research background, significance, and research methods of this article. The body is divided into four chapters:The first chapter introduces the general theory of the witness protection system in the criminal proceedings. The second chapter introduces the main witness protection measures taken in the contemporary United States, Britain and Germany in criminal proceedings. The third chapter focuses on analyzing the problems during the current criminal proceedings which existed in the witness protection system in legislation and judicial, and discussing the reason why witnesses are unwilling to testify on court while combining with actual situation in China. The fourth chapter is the key to this article, the author made some tentative suggestions to witness protection in criminal proceedings from identifying the situation of witness in criminal proceedings from the protection in the case, expanding the scope of witness protection, and determining the witness protection methods in criminal proceedings and from the angle of the legitimate rights and interests against acts of criminal sanctions witness to perfect and improve witness protection system in criminal proceedings in China Legal System, and sincerely hope to make some contribution to the witness protection system. Conclusions summarized the text, and put forward the prospect of the witness protection system in criminal proceedings.
