On Our Country To Appoint A Defense System

The appointed defense system as a democratic system is one of the main realization forms of legal aid system. Through providing legal aid for specific defendant, it can help the defendant to exercise the right of defense, protect the lawful rights and it is the important way to realize human rights and justice. With the further development of the legal system, the fuzziness and blank of appointed defense laws brings certain problems in the judicial practice. Some mechanisms relate to the effective implementation of the appointed defense regulations, the lack of them also increases the difficulty of appointed defense work. So the focus is analyzing problems of the appointed defense system and providing the reference for the appointed defense system.This thesis is divided into five parts. The first part mainly expounds the basic theory of the appointed defense system. This section describes the concept and the meaning of the appointed defense, laying a foundation for further study on the below. The second part shows the different development courses of the appointed defense system, and gets the beneficial enlightenment for the further improvement through the historical reflection on the appointed defense system. The third part summarizes the main problems of the legislative and judicial practices in the appointed defense system. The fourth part compares the appointed defense system of foreign with the China's and summers up the system of our country to provide perfect reference for the appointed defense. The fifth part puts forward to perfect recommendations according to the reality and problems of China and useful experience.The innovation points of this paper include three parts. First, through anglicizing the historical development of the appointed defense system and the factors affecting the system, we can find some favorable enlightenment. Second, it is easy to compare with our country and draw the useful experience by summarizing the defense system of major foreign countries. Third, the suggestions are put forward with pertinence, also fully considering the actual situation of our country, and have certain feasibility.
