The urbanization transformation has made the Chinese society have a great change of"rural"to"city". The social change has produced too many unforeseen new situations and new problems. Referee uncertainty of the outcome may cause the law expected to be damaged to some extent, but at the same time, it is an inevitable and objective existence. The uncertainty of the results of justice from another perspective also shows that the transition rule of law in China's development to a large extent dependent on the legislative process to develop the formulation of legal norms, the development of the people's court in the rules are subject to strict judicial functions restrictions.The article in the third part will discuss another problem of the Chinese court-the judicial discussion of non-effectiveness.
