On The Duty Of Safety And Security Of Tort

With the high-speed development of economic and technology nowadays, various types of infringement cases often occur in public places. Because there is no unified regulation for such disputes, people begin to seek to solve this kind of dispute in the corporate world. Security Obligation then gradually get considerable attention and study, In December 2009, China provided the "Tort Liability Act", Article 37 of the Act stipulated this theory. But still there are some defects from the legal system perspective. This paper mainly analyzes as well as observes the security obligations through the theoretical basis. And also there are some further analysis and deliberation about the defects in the legal provisions. Besides, I have put forward some personal views; and hopefully they could propose some reference value for the improvement of the system.This article mainly discusses the problems about security and safety obligations. And it consists of three parts. The first part analyzes and expounds the theory of the general the safety and security obligations. The second part analyzes as well as compares the main obligations of foreign security to adopt some beneficial aspects to help improve the legal system in China. In the third part, I made a more comprehensive analysis and presentation of the present situation of our security obligation on the legislative status theory, then there are some analysis and deliberation about the defects of the law. At the same time, there are some personal opinions about how to further perfect it.
