| The non-competition system has been put forward and developed for quite a long time and it has played a significant role in protecting commercial confidentialities of enterprises, in keeping the reasonable order of the market economy and in protecting laborers'rights and interests. With its advantages outweighing its disadvantages, the non-competition system marks a progress of the labor relations in the market economy environment. As the market economy thrives, great changes have taken place in people's ways of employment. In fact, there are a number of "job-hopping" and "talent-snatching" accidents, therefore, enterprises often set many kinds of severe limits to the reemployment of laborers. Owing to its short history, the non-competition system in our country is still immature in terms of both theoretical studies and legislative practice. How to make a balance between laborers' right to work and employing units' power of management in order to protect laborers'rights and interests as much as possible becomes an important part of the national labor legislation. This article makes an overall and systematic analysis to the basic theories of the non-competition from the perspective of studies on the protection of laborers'rights and interests; and, making good use of the advanced research fruits and legislative experiences of the developed countries, proposes some suggestions on optimizing the non-competition system of our country and on strengthening the protection of laborers'rights and interests in the hope of doing a better job in maintaining laborers'rights and interests in practice.This article is generally composed of three parts:â… . problems of the non-competition system in our country in terms of the protection of laborers'rights and interests;â…¡. basic theories of the protection of laborers'rights and interests in the non-competition system;â…¢. specific measures to be taken to protect laborers'rights and interests in the non-competition system of our country. |
