Compared with previous versions of Conditions of Contract for Construction, in order to balance the unfair situation between the employer and the contractor on the right of claim, the 1st edition of 1999(the new Red Book) has set up a separate provision (2.5) to define the employer's right of claim for the first time. As far as I concerned, existing research on the contractor's claim is also far more than on the employer's. In view of this situation, this paper is trying to focus on legal analysis on the employer's claim from the perspective of the employer itself. This paper would be made up by three parts, and the analysis of each part will be based on the text of the new Red Book.As the part one, Chapterâ… and Chapterâ…¡are focusing on making a brief overview over the FIDIC organization and the Conditions of Contract for Construction, so that we can make a clear scope of the study. As the part two, Chapterâ…¢is focusing on legal analysis and classification of the provisions related to the employers' right of claim in the text of Conditions of Contract for Construction, so that the employer's right of claim would be defined. As the part 3, Chapterâ…£is focusing on the legal analysis of procedure on resolving the dispute of the employer's claim, so that the employer's claim would be implemented both on substantive law and procedural law.
