Antitrust Settlement System

The anti-trust settlement system is the product of the implementation of anti-monopoly law. With the anti-monopoly law enforcement approach gradually from severe to mild, reconciliation system is also more and more popular around the world.however,the anti-trust settlement system also has some limitations in itself although with some unparalleled advantages.China's anti-trust settlement system also provides a unique system - the operators commitment.But the provisions are too general and abstract, and there are some problems and deficiencies in the system. This article attempts to make some suggestions based on the analysis of settlement system.This article is divided into three parts.The first part is about the general theory of the anti-trust settlement,elaborates the generation and development of anti-trust settlement system and analyzes the reasons for its widely used.Connections and differences are discussed in this part,and the system is divided different types according to different standards.The second part focus on the legitimacy and rationality of conciliation.The article discusses about value and functions of anti-trust settlement system, analyzes anti-trust settlement system achieve the balance between justice and efficiency,freedom and order.And from the perspective of law and economics, settlement system is consistent with transaction cost theory.The third part is about the system of operators Commitment in our country, which belongs to conciliation of enforcement virtually.This part will analyzes how to overcome the "reconciliation paradox". I will present my ideas on the construction of conciliation system, and all the foregoing parts will be summarized in the last part.
