This article studies on legal characters and risk prevention for ship export under Buyer's Credit. Analysis starts with characters of Buyer's Credit as well as its advantages against Seller's Credit. It's followed by dissection on major legal problems for ship export credit which includes:clauses of agreement of ship export under Buyer's Credit which actually has a close linkage to the Arrangement on officially supported export credits (Gentleman's Agreement). Analysis then focus on export credit insurance which is not only a major leverage adopted by the government to support export credit, but also a prevention to political risks beyond regular commercial insurance. As a final section, legal risk of ship export under Buyer's Credit and the corresponding prevention will be covered, and one of the major topics falls on mortgage of ship under construction. |
