| Recently, with the development of social economy and the advancement of scientific technology, the Internet has become a part of the life of citizens, and it has been an indispensable style of life. Because of the nature of illusion and diffuseness of the Internet, the speech in Internet plays a more important role in the process of political decisions which citizens involve in. On the one hand, the prevalence of the Internet promotes political participation of citizens. On the other hand , the speech of citizens in the Internet shows an inclination of anarchy, which may jeopardize stabilization of politics and security of nation. So we must make discreet institutional arrangements for citizens in the circumstance of the Internet. Thus, the author takes right to supervision of citizens in Article 41, the Constitution as a commencement to analyze a series of positive and negative influence which the right gives rise to. And then ,the author will explore and dissect the reasons leading to the negative influence, which can be contributed to resolving various problems.With regard to the above-mentioned content, this dissertation is formed with 4 sections. Section one is mainly to illustrate right to supervision from ontology. At first, the author in the dissertation introduces emergence and evolvement of right to supervision in a historical perspective. Second, the author analyses a series of issues about the subject, object, content and foundation of the right. And then, relating to the Internet circumstance, the author discusses the new characteristic of right to supervision in modern times, which is inclined to the discussion of next sections. Section two is mainly to discuss the influence of right to supervision in the Internet. In a positive sense, right to supervision in the Internet promotes the process of the democratization of politics, and advances the political decision to scientific orientation, and facilitates achievement of constitutional rights. While in a negative sense, right to supervision is prone to control abuse of rights in the Internet, which may impact judicial independence, infringe individual privacy, and retard administration of the government. All of these issues must be emphasized. Section three is to elucidate the causes of social problems which in the above paragraphs have been discussed. The author in the dissertation finds those reasons in from macro to micro perspective . As to the macro one, three reasons can be readily attributed to negative phenomena: economic reasons, political reasons and cultural reasons. While the micro one contains three reasons in a narrow sense: uncertain identity of the subject of right to supervision, group polarization, excessive limitation of freedom of speech. Section four submits regulations to solve the problems. Under a series of severe social problems, these measures should be taken into consideration such as guide of public opinion, control of scientific technology, device of institution, and moral drive. As far as the author concerns, those social problems will be solved by the compromise measures. |
