Traffic Crime, Drunk Driving Problem Research

Traffice offences is a kind of Negligence crime . This paper is mainly based on the criminal penalties for drunk driving The text mainly divides into two parts . The first part is to discuss the problem of traffic offences, and the next part is mainly discussing about the punishment of drunk driving.In the first part, this paper includes two sections of the criminal legislation of traffice offences and some typical problems of traffice offences.Then the author put forwards the views of herself.The traffice offences of crimal law begins in 1956.After several times of modification ,then it finally formed in 1979 crimal law. As social changes, the 1979 criminal law is no longer fit for the social development, In this premise, We introduced the criminal law of today.Later on , In order to make the application of criminal law article can be more specific, The supreme promulgated the interpretation of traffic offences.It includes the related problems of traffice offences. The author studied the three important constitutive elements.In fact , scholars to every problem have different opinions. Based on the analysis of the other opinions ,the author put forward its own views .The next part of the article is to disscuss the drunk driving puttint into the crimal law.First,the author put forward the background of problem . Whether from the social reality or scholars on calls , it is people oriented.Next, the author expounds the necessity and feasibility. Then, the author put into other countries view about drunk driving regulation, to the United States, Britain, Canada's drunk driving problems on the detailed exposition. However,the author analyzed series problems of drunk driving ,including legislative standard, the relationship of public security and the implementation issues, With the execution of criminal law, drunk driving laws will paly a important role .
