Current our country social economy rapid development, and achieved remarkable results, but at the same time of rapid economic development, there have been many problems, now we people live in the natural environment worsening, resource utilization is low, the increasingly serious water pollution, urban residents fog haze which cause serious damage to health, in the process of transformation from planned economy to market economy development, the state-owned assets with the phenomenon of infringement, misappropriation, illegal or irregular act committed by a state-owned monopoly enterprises use their position to collect fees, do not pay enough attention to the protection of cultural heritage, the violation of consumer rights and interests behavior increases, and so on, these behavior has a serious violation to the rights and interests of the public, but they also can not get timely and effective sanctions, although the current increasingly improve and perfect the socialist rule of law system in China, but the public welfare lawsuit system of legislation is still relatively slow, and the public welfare lawsuit not harmonious, the growing of the judicial practice in 2012, the revised provisions of article 55 of the civil procedure law ":" to pollute the environment, infringes upon the lawful rights and interests, such as many consumers harm social public interests, the law of authorities and relevant organizations may bring a suit before a people’s court." The establishment and improvement of the public interest litigation system in China is important, but many other need to perfect, which can’t solve in real life, the problem of infringement of public interest litigation.
