Research On Consumer Public Interest Litigation System

Consumer public interest litigation is that when the public interest of the consumer is damaged or the normal business order is disturbed,the relevant organs and organizations in accordance with the law to the people's court for violations of the system.The purpose is to protect the legitimate rights and interests of consumers,to maintain a healthy and orderly business order,and ultimately promote the harmonious development of China's society.However,in judicial practice,the relevant legal provisions related to the number of cases more careless,less,which makes the system have a series of problems in the specific application.This article from the first case of China's consumer public interest litigation,first of all,the definition of public interest litigation,the characteristics and the need for a comprehensive exposition.Then analyzes the status quo of China's public interest litigation and the existing problems from the legal and practical point of view,pointed out that the current relevant legal provisions on consumer litigation regulations also has strong principle,main prosecution scope is too narrow,issues such as the lack of supporting system.Finally,based on the situation of our country,we put forward some feasible suggestions on the establishment of the scope of the main range of litigation,the perfection of the system design and the supporting system.
