With the accelerated process of China’s modernization, human right has received unprecedented concerns in all areas of the social practice. And promotion and guarantee of equality in woman’s employment right is an important point to realize equality in human right. Employment tendency is severe in China on the whole during the time that China faces a new round of adjustment in economic structure, in which sexual discrimination in woman’s employment has become a bigger and bigger hinder in reality for realizing the equal right in woman’s employment. Establishment, improvement, and guarantee of guarantee system for rights and interests in woman’s employment is significant in reality and in the long term for guarantee and solve woman’s employment right in China.This article, from discrimination in woman’s employment in China as a breakthrough point, profoundly analyzes relevant problems existing mainly in the legal aspects for sexual discrimination in woman’s employment in China with regards of its reason and legal problems. It profoundly borrows and accepts Europe’s and America’s precious experience in government of law for anti sexual discrimination in woman’s employment with respects of eliminating sexual discrimination in woman’s employment, improving law and regulation related to sexual discrimination in woman’s employment, promoting and improving legislation related to sexual discrimination in woman’s employment, strengthening guarantee on law enforcement in sexual discrimination in woman’s employment, and establishing a specific institution to guarantee equality in woman’s employment. It presents legal and active advices on anti sexual discrimination in woman’s employment that is applicable to China’s current national situation, and makes advantageous exploration, on the aspect of law, in the problem of sexual discrimination in woman’s employment in China.
