Gender discrimination in employment field,age discrimination,health discrimination unfair phenomenon has become one of serious problems in our country,however our country government and the public not enough emphasis on the above issues.Employment discrimination is the destruction of the equal rights of employment protection by law,but due to the equal rights of employment in the absence of legislative and judicial relief is imperfect,cause the employment equality act just a stay on paper.The purpose of the thesis is through analyzing the current situation of employment discrimination,and make up of the employment discrimination law loophole,provide effective relief way for workers,in order to solve the problem of employment discrimination,to protect the laborer equal rights of employment.Paper mainly adopts literature research,comparative analysis and empirical analysis on three methods,related problems on employment discrimination are studied and discussed.Literature research for the paper provided the theory basis,at the same time for the paper provides the research train of thought;The comparative analysis method for paper anti employment discrimination law system advanced experience abroad.The empirical analysis to provide the practical support.First of all,the paper elaborates the basic theories of employment discrimination.From the concept of employment discrimination,combined with international conventions and foreign laws on employment discrimination of the concept of regulation and the regulation of our country labor law,make a preliminary definition of the concept of employment discrimination,and criterion of employment discrimination made a more detailed analysis.At the same time,the specific forms of employment discrimination and genetic theory are respectively described,and the paper discusses the necessity of the employment discrimination.Secondly,the paper analyzes the current situation of our country at present the employment discrimination.Starting from the existing about the employment discrimination law,has carried on the induction,the according to the definition of employment discrimination and judgment standard,and further points out that the existing legal deficiency of its rules.Finally,the paper aiming at the existing problem of our country at present the employment discrimination,discusses how to perfect accord with China's national conditions in our country and can keep up with the trend of the international anti employment discrimination law relief system.Mainly from the formulate detailed rules for the implementation"employment promotion law",perfecting the law enforcement main body,the relief procedure,v.compensation after four aspects,including in formulate detailed rules for the implementation "employment promotion law",detailed elaborated how to define the employment discrimination and employment discrimination criterion,provides the basis for perfecting the employment discrimination legislation.Reference at the same time,the United States,Germany and other foreign advanced experience,the employment discrimination for the employment discrimination legislation in China,which can be used for reference to further improve the legal system of anti-discrimination employment in China.
