On The Effective Exercise Of Supervision Power In China 's Supervision Organs

The constitution and the law of our country give the power to the administrat ive supervisory organ for supervising the exercise of administrative functions and the implementation of administrative actions. As one of the government administra tive organs, the administrative supervisory organ plays an important role in superv ising and urging the government organs and their personnel execution of power t o perform their duties and prevent improper or illegal administrative aspects accor ding to statutory power limit and procedures strictly. However, in practice, improp er administrative,illegal administrative,or the behavior of damage public interests still happen frequently. It highlights the lack of administrative power supervision. Thus,this paper will focus on the problems which the supervisory organ will face in the process of performing administrative supervision function, it will also do re search on the exercise path of strengthening supervision.In this paper, it will first define the content and property of supervision of supervisory organ in our country, and then pay great attention to three concepts that are supervision and inspection, administrative supervision and administrative inspection, supervision right and super power. It will clarify the function, main way and scope of of supervisory organ in our country. Then it will introduce the supervision of the legislation, the system construction’s current situation, and the outstanding problems, including the incomplete law enforcement, offside or absence of supervision, bad performing supervision system, damaging to the lawful rights and interests of the supervision object, weak self supervision and weak administrative punishment in the process of performing administrative supervision. This paper will analyze above problems. The reasons mainly include imperfect legal system, independent factors of supervision system and imperfect supervision of operation mechanism. In the end, the paper will put forward the countermeasures and suggestions of strengthening supervision, completing existing law, establishing and improving the administrative supervision laws and regulations, strengthening the construction of supervision system, making sure independent the power of supervision, improving way of supervision, standard surveillance program, strengthening the administrative accountability, paying attention to object’s legal interest and secure supervision, perfecting the mechanism of self supervision, establishing motivating security system, and improving the quality of supervision subject in order to perfect the supervision working mechanism.
