A Study On The Perfection Of Legislation System Under The View Of Rule Of Law In China

Entering the second ten-year period of the new century, our ruling party has understood and emphasized “the rule of law” in a historical height. The Eighteenth National Congress of the CPC, its Third Plenary Session and Fourth Plenary Session,have depicted a grand blueprint of “China under the rue of law”. The rule of law, as the basic means of governing the country, has gradually become the common ground of people, and been carried forward smoothly.Meanwhile, scientific legislation, strict enforcement, impartial justice, and universal compliance have become the fundamental guide in today’s law construction.Legislation has become the key section and starting work in law construction. It has become a key research project how to improve the quality of legislation, and function its implementing role in major social reforms at present.Legislation system is an organic integration of the principles and systems concerning legislation rights, its enforcement, and its carriers. Many prescriptive requirements are set for legislation,which have direct influence on the carrying out of legislation process, and fundamental influence on the improvement of legislation quality.Above all, the paper chooses the improvement of legislation system as the research perspective, and tries to find the problems and defects based on the analysis of the current legislation system in our country; the paper also puts forward some corresponding strategies and suggestions for constructing a perfect legislation system,in an effort to foster the improvement of legislation quality and in turn the construction of “China under the rule of law”.
