Consumers’ transaction in e-commerce through the Internet seems like a kind of folk behavior, essentially it is still the business. Someone thinks it is the new civil activities in "virtual world" out of our real world, however, this "virtual world" is actually the "legal vacuum" that is beyond the reality legal system. Obviously, this understanding to e-commerce is one-sided and superficial. Various trading legal relationship formed in the electronic commerce still need to be regulated and adjusted by the related legal system. At the same time, whether in the vertical relationships between government’s supervision and management to the e-commerce activities, or in the equal relationship between enterprise and enterprise, between enterprises and consumers, have different degrees of influence and challenge for current law system. It’s impossible to expound all the problems related to consumers’ rights and interests protection in e-commerce. However, considering the different influence of e-commerce to the traditional civil and commercial legal relations especially the part of protecting consumers’ rights and interests, it is necessary to analyze and solve these problems. Some problems can be solved in electronic commerce legislation, legal system and beyond the study of the law.
