Research On The Protection Of Labor Rights And Interests Of Car-hailing Drivers

With the concept of shared economy,"Internet + traditional industry," the new business model came into being,which is the traditional industry with the Internet technology platform to achieve innovation and development model.It not only promotes the rapid economic development,but also improves people's life.Car-hailing service is one of them.It uses the Internet technology to achieve the optimal sharing of information,breaking the original closed traffic system.Car-hailing service used the social vehicle resources through the platform and the passengers,to achieve the maximum utilization of social resources.July 14,2016,The Interim Measures for the Administration of online Taxi Booking Business Operations and Services,adopted at the 15 th executive meeting of the Ministry of Transport,And it implemented from November 1.The car-hailing has been subjected to legal supervision.In today's booming economy,there are still many shortcomings in this business model that relies on the Internet platform.Due to the various forms of car-hailing,the legal regulation of the employment relation about car-hailing is blank,and the protection of labor rights and interests of car-hailing drivers is the lack of specialized research.Therefore,it order to promote the healthy development of the network of the car-hailing and protect the legitimate rights and interests of the workers,this paper will discuss the protection of labor rights and interests of car-hailing drivers.The paper briefly introduces the different employment patterns of the car-hailing platform,and then starts from the judicial differences in the current legal practice of our country,and analyze the legal relationship between the platform and the driver in the different mode of employment.After combing the legal relationship between the two sides,drawing lessons from the America on the flexible employment groups to protect the rights and interests,this paper combined with our country's specific circumstances,from seven aspects to propose recommendations about the protection of rights and interests of car-hailing drivers.
